MINUTES
April 14, 2005


R. Maloney made a motion to amend the agenda and bring new business up ahead of the public hearing.  P. Wright seconded.  Vote: All in favor.

REGULAR MEETING:  Members present:  P. Wright, N. Wilson, R. Maloney, A. Poole, and M.
Masinda seated for J. Prusak.

CALL TO ORDER:  7:31 p.m.
NEW BUSINESS:  
File #ZBA2005-03 – Application for a Special Exception for an assembly workshop at 156 River Rd. (Map 15, Lot 27A) Owner: Thomas Buccino; Applicant: John Phelps (Received 4/14/05; Hearing: 5/12/05; Decision 7/14/05)  T. Buccino and J. Phelps were present at meeting and discussed where the operation would to be situated in the old storage building built over the cause way and attached to the rear of the main building. It was decided that no site walk was needed but memos from the Wetlands Agent and Health Department.

File #ZBA2005-02 – Application to allow for the creation of a third abutting rear lot (application for a variance at approve a rear lot merged with non-conforming parcel that abuts two (2) adjacent rear lots) on property at 212 River Rd. (Map 19, Lots 25 & 25A) Owner/Applicant:  Lynnthea Mackovich (Received 4/14/05; Site Walk 5/3/05 at 6 p.m.; Public Hearing on 5/12/05; Decision by 7/14/05)

PUBLIC HEARING

·       Continued Hearing on File #ZBA2005-01 – Application for a 15’ side line variance to amend previous variance granted 5/11/89 requesting an 8’ variance to construct a 1 ½ car attached garage on property at 14 Ridgewood Rd (Map 14, Lot 74) Owner/Applicant:  Sharon & Richard Bigge.

Hearing opened at 7:40 p.m.
Members present:  P. Wright, N. Wilson, R. Maloney, A. Poole, and M. Masinda seated for J. Prusak.

Owners Richard and Sharon Bigge were also present.

Mr. Bigge presented a site plan of the proposed lot line changes.  It was stamped and received.  He explained that he would have the final plan and the real estate agreement submitted if and when he was granted a variance.

N. Wilson asked if the proposed properties being swapped were the same size.  

R. Bigge stated that they are with a little different formation.

R. Maloney wanted to get the distances correct.  

The commission after much discussion decided that the original variance had 12’, which was the proposed garage, plus you had 17’ more feet then you would have had 8’ to the proposed boundary.  What the question now is how far do we go from the 8’ variance to get to the new property line?  

R. Maloney stated that the commission has to figure out based on the old variance and the proposed old garage does R. Bigge need a variance?  Bigge might not need a variance if he can get the lot line change. The new proposed garage is 18’ wide.

R. Maloney made a motion to close the public hearing, A. Poole seconded.  Vote:  All in favor.
Hearing closed at 7:55 p.m.

Returned to the regular meeting.

OLD BUSINESS:  R. Maloney requested a motion on the above application before discussion.  R. Maloney moved that the commission approve application 2005-01 for a sideline variance.  P. Wright seconded.

Commission discussed the distances regarding the new proposed garage and how far it would be to the property line and how much of a variance would need to be granted.

A friendly amendment to the motion R. Maloney move that the commission approve application 2005-01 request for a sideline variance as the facts present themselves we have a 23’ sideline that exists, because the existing house encroaches upon the sideline, we have an 8’ sideline variance that exists, in addition to that variance the commission is going to grant an additional 11’ sideline variance. The distance to the abutter would be 4’ based on the A-2 survey and all the representation that the applicant has made and contingent on the execution of the real estate agreement which is not part and parcel of this hearing, this agreement has been signed and dated the 14th of April, 2005 and may not be amended or changed nor may the proposed survey be amended or changed or this granting of a variance is null and void.  We expect this property to be deeded immediately and presented to us.  It is unusual that the commission would do this but it seems to be truthful and all there.  N. Wilson seconded.  Vote: All in favor.

MINUTES:  N. Wilson had an amendment to the 3/10/05 minutes changing “….garage from being built on the right (should be left) side of the house.” R. Maloney made the motion to approve minutes of 3/10/05 and 3/24/05, N. Wilson seconded.  Vote:  All in favor.

CORRESPONDENCE:
DISCUSSION:       Packets from the CT Bar Assoc. concerning the CT Land Use Law for Municipal
Land Use Agencies, Boards and Commissions were distributed and discussed.

ADJOURNMENT:  R. Maloney made a motion to adjourn, A. Poole seconded. Vote: All in favor.
